A Commercial Lease Application allows a landlord to obtain information from prospective tenants interested in renting a commercial property. Basic information, including prior business rental history, business information and credit related information, is requested through this application.  The application allows the prospective tenant to consent to a credit and background check by the landlord. The prospective tenant also verifies that the information provided is true and correct.

It is vitally important for the landlord to thoroughly screen all prospective tenants, checking credit history, references and background. Part of a good screening process is using a good comprehensive Commercial Lease Application, and following up and checking the information the prospective tenant gives you.  The information gathered through this application will be useful for the Landlord in making a decision as to whether to rent the premises to the prospective tenant.

Before renting to a tenant, the landlord should check with the prospective tenants previous landlords and call any references that the tenant provides.  Obtaining a credit report is particularly valuable because it will tell you if the prospective tenant has a good credit history and have ever filed bankruptcy. If you determine that you do not want to rent to a particular tenant because of an adverse credit report, the landlord must send the applicant a letter informing the applicant the reason they were rejected, the name of the credit agency used and inform the applicant that they are entitled to a copy of the report by requesting it from the agency. To avoid any legal problems, it is important for the landlord be fair and even-handed in the screening of all applicants.

Landlords should not discriminate against any applicant on any illegal or unlawful basis, including race, colour, religion, sex, national origin, age, disability, family status or any other basis prohibited by laws. Such discrimination as the sole basis of refusal to rent is illegal in India.

q   The Commercial Lease Application should be signed by the prospective tenant or tenants.  

q   The landlord should perform a thorough investigation of the prospective commercial tenant based on the information provided in the Commercial Lease Application. The landlord should keep copies of any correspondence relating to the application and written notes of any telephone conversations with and relating to the prospective tenant(s).

q   It is a good idea to request some form of identification (i.e. drivers license, passport, etc.) from the applicant after the application is completed.

q   Landlord should make sure that all the information provided by the prospective tenant(s) “makes sense” and that everything matches (i.e. drivers license information matches information on application, etc.)

q   The landlord should keep the original application.

q   A copy of the application may be provided to the prospective commercial tenant.

q   If an applicant does not meet landlords criteria, landlord should document the reason for the decision. Decisions to reject a Lease Application should be made in good faith and for legitimate legal purposes.

The following instructions will guide the user through each section of the Commercial Lease Application so that all terms are fully understood.

Business Information: The prospective tenant will fill in the full name of their business, address and phone number, date of establishment, number of employees, type of business, gross annual revenue, tax ID number and email address.  Its a good idea to physically inspect a prospective applicants drivers license or obtain a copy for your files; this way you can verify that the applicant is in fact the same person as on the license and over 18 years of age.

Business Rental History: The tenant will complete this portion listing the basic information about their current business rental history including their current and prior Landlords name and phone number. It is important for the landlord to call and check any past history as valuable information can be gathered by speaking to the applicants past landlords.

Credit/Personal References:  The applicant will complete the contact information for credit and/or personal references. As with all references, the landlord should call and follow up to gather information.  While these references are informative, they arent foolproof.  Remember that the applicant has picked the references they felt comfortable giving you.

Bank References:  Applicant will fill in their bank information. Without a signed statement by the applicant, it will be difficult to get any specifics about the applicants account although you may be able to confirm that they do have an account there.  If the applicant does not have a bank account, this should be a red flag to a landlord.  If that is the case, the landlord should specify how they would like their rent paid, by cashiers check, for instance.

Consent to Credit Check: The applicant will fill in information and consent to a credit check.  A credit check on the applicant is a must.  There is usually a small fee

associated with this, which is often charged to the applicant.  There are a variety of businesses that can do this or you can contact the credit agencies directly, who will provide a three-credit bureau report.  If you use an agency, they will be able to assist in conducting a criminal background check as well.

Signature Block: Make sure that the commercial lease applicant carefully reads the application.  By signing the application they are authorising the landlord to conduct a background check. Have the applicant sign and date the form. Keep the original and provide the applicant with a copy.
